A person who is charged with a DUI under 21 can have numerous problems and can have additional charges for a minor in possession of alcohol or drug possession, which standing along can also put the young person in jail, cost them additional fines and a driver’s license suspension.

DUI for persons under 21 is substantially different than for adults. Here is what is required, and the penalties for a DUI under 21 case:

  1. Blood alcohol level of 0.02 grams is standard for DUI in an offender who is under 21.
  2. Imprisonment not less than 10 days nor more than 12 months (although the Judge may suspend all but 24 hours of imprisonment)

  4. Fine not less than $300 nor more than $1,000
  5. Not less than 40 hours community service
  6. Attend and complete Drug and Alcohol Risk Reduction School; (DUI school)
  7. Revocation of drivers licenses, however after 6 months following the effective date of the revocation and subject to the examination requirements for obtaining a driver’s license the individual my apply for their driver’s license. If the blood alcohol level was 0.08 or more the revocation is for 12 months. A second or subsequent DUI the revocation is for 12 months. Must have completed the Drug and Alcohol Risk Reduction School, and pay a fine.
  8. Usually a drug and alcohol evaluation and any treatment
  9. Usually a MADD Victim Impact Panel

If you have other driving offenses, they can be added in as well. For example, typically in a DUI case there is a failure to maintain lane charge. That is a misdemeanor under Georgia Law and can cause additional probation (either concurrent or consecutive), and points on your license. if you are under 18 and get any offenses either by themselves or in combination of offenses, you can lose your license for that as well. In addition, for the underage possession charges you can receive additional probation and jail time.
